REFUND AND RETURN POLICY

Effective Date:

This Refund and Return Policy (ā€œPolicyā€) governs subscription purchases, subscription cancellations, and refund procedures relating to the Xplore Work mobile application and associated digital services (ā€œPlatformā€) provided by XPLORE WORK YAZ. TİC. LTD. ŞTİ. (ā€œXplore Workā€).

Subscription purchases within the Xplore Work application may be processed through the Apple App Store and Apple’s in-app purchase system (ā€œApple In-App Purchaseā€).

For purchases made through Apple, payment processing, billing, subscription management, and refund procedures are subject to Apple’s payment infrastructure and Apple’s applicable terms, conditions, and policies.

This Policy shall be applied together with the User Agreement, Payment Policy, Terms and Conditions, and other applicable policies published on the Platform.

Any mandatory rights granted to users under applicable consumer protection laws remain fully reserved.

1. SCOPE OF THE POLICY

This Policy applies to the following paid digital services offered by Xplore Work and available for purchase through the Apple App Store:

  • Monthly, annual, or other periodic subscription plans
  • Paid membership packages
  • Listing publication rights provided under a subscription
  • Messaging capacity and additional communication features
  • Rights to add branches or business locations
  • Map visibility and related paid features
  • Additional digital services provided to corporate accounts
  • Other paid features that may be offered under subscriptions on the Platform

This Policy applies only to paid digital services and subscriptions provided by Xplore Work.

Sales of goods or services, commercial agreements, deliveries, or other commercial transactions conducted between Xplore Work users are outside the scope of this Policy.

Xplore Work is not the seller, buyer, payment intermediary, or contracting party in commercial transactions between users.

2. PAYMENTS MADE THROUGH THE APPLE APP STORE

Subscription purchases made through the Xplore Work iOS application are processed through Apple’s In-App Purchase system.

For such transactions, the payment method used by the user is the payment method associated with the user’s Apple Account.

For purchases made through Apple, payment information processing, collection, payment verification, billing, and related financial transactions are carried out through Apple’s systems.

Xplore Work does not directly receive or store the full debit card or credit card details registered with Apple.

Transactions processed by Apple are subject to the Apple Media Services Terms and Conditions and Apple policies applicable in the user’s country or region.

3. AUTOMATIC RENEWAL OF SUBSCRIPTIONS

Unless otherwise stated on the purchase screen, Xplore Work subscriptions may be offered as automatically renewing subscriptions.

Before a subscription is purchased, the following information relating to the subscription plan is presented through the Apple purchase interface and/or by Xplore Work:

  • Subscription name
  • Subscription period
  • Price
  • Renewal terms
  • Other material subscription information

While automatic renewal remains enabled, the subscription may renew in accordance with Apple’s applicable renewal terms, and the subscription fee may be charged to the payment method associated with the user’s Apple Account.

4. CANCELLATION OF SUBSCRIPTIONS

Xplore Work subscriptions purchased through the Apple App Store must be canceled through Apple’s subscription management system.

Users may cancel their subscriptions through the subscription management section of their Apple Account.

As a general rule, canceling a subscription does not immediately terminate the current paid subscription period.

Unless otherwise determined by Apple or a refund is granted, the user may continue to access the relevant subscription features until the end of the current subscription period.

Cancellation prevents the subscription from automatically renewing for the next period.

Deleting only the Xplore Work account may not automatically cancel an active subscription managed through Apple.

Accordingly, users are responsible for separately reviewing and, where necessary, canceling their active Apple subscription through Apple’s subscription management system.

5. REFUNDS FOR APPLE PURCHASES

Refund requests relating to Xplore Work purchases made through the Apple App Store or Apple In-App Purchase system are evaluated by Apple.

Xplore Work may not have the authority or technical ability to directly refund an App Store purchase collected by Apple to the user’s payment method.

Accordingly, refund requests for purchases made through Apple must be submitted through Apple’s official refund system.

Users may sign in to Apple’s ā€œReport a Problemā€ service using their Apple Account and:

  • Select the option to request a refund
  • State the reason for the refund request
  • Select the relevant Xplore Work subscription or purchase
  • Submit the request to Apple

Apple determines whether a refund request is approved in accordance with applicable Apple policies and applicable law.

Xplore Work cannot guarantee Apple’s refund decision and cannot issue a refund commitment on Apple’s behalf.

6. REFUNDS APPROVED BY APPLE

If Apple approves a refund for a Xplore Work subscription or purchase, the refund is processed by Apple.

The refund is handled in accordance with Apple’s payment system and the payment method used for the relevant purchase.

If Apple processes a refund, Xplore Work may, based on the transaction or subscription status information provided by Apple:

  • Terminate the relevant subscription
  • Remove access to paid features associated with the refunded purchase
  • Update the relevant subscription entitlements
  • Align the user’s subscription status with the current status reported by Apple

Continued access to paid services associated with a refunded subscription or purchase is not guaranteed.

7. EVALUATION OF REFUND REQUESTS

The final assessment of refund requests relating to purchases made through Apple is conducted by Apple.

Eligibility for a refund may vary depending on factors including:

  • The country or region where the purchase was made
  • The user’s legal status
  • The type of purchase
  • The usage status of the subscription or service
  • The reason for the refund request
  • Apple’s applicable policies
  • Applicable consumer protection laws

Technical support provided by Xplore Work or technical information supplied for submission to Apple does not mean that a refund will be approved.

8. STATUTORY WITHDRAWAL AND REFUND RIGHTS OF CONSUMERS

Any mandatory rights of users qualifying as consumers under applicable consumer protection laws remain reserved.

For purchases made through the Apple App Store, the application of withdrawal, cancellation, or refund rights may vary depending on the user’s country or region and the nature of the relevant purchase.

Purchases of digital content and services supplied through Apple may be subject to the withdrawal and refund provisions set out in the Apple Media Services Terms and Conditions.

Where applicable law grants users rights that cannot be waived or restricted by contract, those rights shall prevail over any conflicting provision of this Policy.

9. B2B COMMERCIAL USERS

Companies, merchants, businesses, producers, suppliers, distributors, and other corporate users using Xplore Work for commercial or professional purposes (ā€œB2B Usersā€) are not entitled to consumer-specific withdrawal rights to the extent they do not qualify as consumers under applicable law.

However, where a B2B User purchases a subscription through the Apple App Store, payment processing, subscription management, and any refund process that may be made available by Apple are handled through Apple’s relevant systems and policies.

If Apple grants a refund for a particular purchase, Xplore Work may update the relevant subscription status based on the transaction information provided by Apple.

10. TECHNICAL ISSUES

If a user is materially unable to benefit from paid subscription services due to a serious or ongoing technical issue attributable to Xplore Work, the user may first contact Xplore Work support.

Depending on the nature of the technical issue, Xplore Work may:

  • Investigate the issue
  • Provide a technical solution
  • Verify the user’s subscription status
  • Direct the user to request a refund through Apple where appropriate
  • Apply other technical or subscription-related solutions permitted by Apple

Where a purchase collected by Apple must be refunded through Apple, Xplore Work cannot directly process the financial refund.

Any mandatory rights arising under applicable law remain reserved.

11. DUPLICATE OR INCORRECT CHARGES

If a user believes that Apple has made a duplicate or incorrect charge for the same Xplore Work subscription or purchase, the user should review their Apple purchase history and, where appropriate, contact Apple Support or submit a request through Apple’s refund system.

Xplore Work may assist, to the extent technically possible, with verification of the subscription or in-app purchase status.

Any financial correction or refund of charges processed by Apple is handled through Apple’s payment system.

12. UNAUTHORIZED PURCHASES

If a user believes that a Xplore Work purchase has been made through their Apple Account without authorization, the user should contact Apple without delay and take appropriate steps to secure their Apple Account.

The user may also notify Xplore Work.

For security purposes, Xplore Work may temporarily restrict the relevant account or request additional verification.

Where the purchase was collected by Apple, the financial assessment and any refund relating to an unauthorized purchase are subject to Apple’s applicable procedures.

13. CLOSURE OF THE XPLORE WORK ACCOUNT

Deleting or closing a Xplore Work account and canceling an Apple subscription are separate actions.

Deleting the user’s Xplore Work account may not automatically terminate an active subscription managed by Apple.

Before deleting their account, users should review any active Xplore Work subscription in their Apple Account and, if they do not wish the subscription to continue, cancel it through Apple’s subscription management system.

Xplore Work may provide a notice during the account deletion process reminding the user to review any active subscription.

14. SUSPENSION OR TERMINATION OF AN ACCOUNT DUE TO USER VIOLATION

Xplore Work may suspend or terminate a user’s account in the event of a serious violation of:

  • The User Agreement
  • The Community Guidelines
  • Platform policies
  • Applicable law

This may include fraud, submission of fraudulent documents, sanctions or embargo violations, unlawful activities, intellectual property infringement, or activities that threaten Platform security.

Suspension or termination of a Xplore Work account does not automatically make purchases made through Apple eligible for a refund.

Refund requests relating to Apple purchases are evaluated under Apple’s applicable procedures.

Any mandatory rights arising under applicable law remain reserved.

15. EFFECT OF AN APPLE REFUND ON PLATFORM ENTITLEMENTS

If Apple issues a full or partial refund for a Xplore Work subscription or in-app purchase, Xplore Work may modify the relevant digital entitlements in accordance with the transaction information provided by Apple.

In this context, Xplore Work may:

  • Terminate the subscription
  • Change the paid membership tier
  • Remove features associated with the refunded service
  • Update available listing, messaging, or other subscription entitlements

These actions are not punitive measures. They are taken to ensure that the user’s entitlements on the Platform correspond to the current purchase and subscription status reported by Apple.

16. TIME REQUIRED FOR REFUNDS TO REACH THE USER

The time required for Apple to review a refund request and for an approved refund to appear on the user’s payment method is subject to Apple’s procedures.

Apple’s approval of a refund does not necessarily mean that the amount will immediately appear in the user’s bank account or payment method.

Processing time may vary depending on the payment method, bank, card issuer, and relevant financial system.

Xplore Work has no control over processing times applied by Apple or the user’s financial institution.

17. EXCHANGE RATES, TAXES, AND APPLE BILLING

The currency, taxation, pricing, and billing applicable to purchases made through Apple may be determined by Apple’s payment system and the user’s App Store country or region.

Exchange rate differences, bank fees, taxes, or other payment-related amounts may be subject to the systems and policies of Apple and/or the relevant financial institutions.

Xplore Work has no control over exchange rate differences or third-party financial charges arising from amounts directly collected by Apple or Apple’s payment infrastructure.

18. ABUSE OF THE REFUND SYSTEM

Xplore Work and Apple may maintain their own security mechanisms against fraud, abuse, and manipulative transactions.

If a user:

  • Systematically submits false refund requests after benefiting from a service
  • Manipulates purchase or refund systems through multiple accounts
  • Submits false payment or refund documents
  • Engages in conduct intended to mislead Apple or Xplore Work systems

Xplore Work may, in accordance with applicable law, review the relevant account, request additional verification, temporarily restrict the account, or apply other measures provided under the User Agreement.

This provision does not prevent users from submitting legitimate and good-faith refund requests.

19. RESPONSIBILITIES OF XPLORE WORK AND APPLE

Xplore Work is responsible for the functionality of the application and Xplore Work services, user accounts, company verification, and Platform features.

For purchases made through Apple, Apple handles payment, billing, subscription management, and refund processes within its own systems.

Xplore Work cannot change Apple’s refund decisions, approve refunds on Apple’s behalf, or directly return amounts collected by Apple to the user’s Apple payment method.

However, Xplore Work may provide support in investigating technical issues and verifying subscription status where appropriate.

20. CHANGES TO THIS POLICY

Xplore Work may update this Policy in response to changes in Apple App Store policies, payment infrastructure, subscription systems, applicable law, or Platform services.

The current version of this Policy will be published on the Platform.

Any vested or non-waivable rights arising under mandatory law remain reserved.

21. GOVERNING LAW AND CONSUMER RIGHTS

This Policy is governed by the laws of the Republic of Türkiye, subject to provisions directly governing payment and refund processes carried out by Apple.

The rights of users qualifying as consumers in Türkiye under Law No. 6502 on Consumer Protection and other applicable mandatory consumer protection legislation remain reserved.

Nothing in this Policy limits consumers’ rights to apply to competent Consumer Arbitration Committees, Consumer Courts, or other authorized bodies.

For disputes between Xplore Work and commercial users, the governing law and jurisdiction provisions set out in the User Agreement shall apply.
